In Rhode Island, your employer has to prove that you committed willful misconduct or violated a company policy or procedure that had been enforced uniformly before your unemployment claim can be denied. For example, if your employer fired you for missing work on three consecutive days, you cannot be denied unemployment benefits if the employer did not enforce that policy uniformly. If you quit your job, the burden of proof is on you to prove that you had a good reason to quit, such as sexual harassment or illegal employment discrimination.

You Have a Right to Appeal a Denial of Unemployment Insurance Benefits

Whenever the Rhode Island Department of Labor and Training receives two versions of how you came to lose your job, your unemployment insurance claim will be denied. You have a right to appeal this decision and to have a lawyer represent you at the hearing. However, the time to appeal a denial is limited, so you must act quickly.
